A former Newfolden High School English Teacher accused in a Marshall County pornography case, is a free man today.
In a ruling issued Friday, District Judge Jeffery Remick dismissed charges against 29 year old Justin Adelmann (eh-dell-man) for lack of probable cause, ordering the file closed without further hearing and Adelmann’s cash bail returned.
Adelmann was charged in February with 3 felonies; Use of a Minor in Sexual Performance, Possession, and Dissemination of Pornographic Work Involving a Minor, after investigators with the Marshall County Sheriff’s Department discovered partially nude photos of a 16 year old student in the girl’s email account. The photo’s had been taken by Adelmann – a Language Arts Instructor at Marshall County Central High School in Newfolden – after school at Adelmann’s apartment. Adelmann was immediately suspended, then permanently terminated from his job in March.
In making his decision, Judge Remick said the photos may constitute pornography from his personal view-point, but not criminal pornography as it is defined by Minnesota Law and he takes issue with Lawmakers for not better protecting children in Minnesota.
